The Prosecutor Vetting Commission has filed an appeal with the Supreme Court of Justice challenging the decision of the Superior Council of Prosecutors (SCP) passing anti-corruption prosecutor Andrei Balan, following a resumed evaluation.
The appeal challenges the legality of the SCP decision, which rejected the Commission’s Panel A resumed evaluation report recommending that the prosecutor fail the evaluation.
Initial evaluation procedure
Following the assessment of Prosecutor Andrei Balan’s ethical and financial integrity, Panel A identified concerns regarding his financial integrity and issued a report recommending that he fail the evaluation. Panel A found that Mr. Balan failed to adequately explain the source of some of his income and savings.
In October 2025, the SCP rejected the Panel’s initial evaluation report and ordered a resumed evaluation, citing issues related to the savings at the beginning of the evaluation period, the plausibility of certain loans, and the methodology used to estimate household consumption expenses.
Resumed evaluation procedure
During the re-evaluation process, the Panel addressed the issues raised by the SCP. The Panel maintained its initial conclusion that Mr. Balan failed to satisfy the criteria for financial integrity. Nevertheless, on 26 May 2026, the SCP rejected the Panel’s report and passed the subject.
Under the law, the Commission may appeal such decisions. The Supreme Court of Justice shall review the appeals within 30 days.
