The Prosecutor Vetting Commission has challenged a decision by the Superior Council of Prosecutors (SCP) concerning anticorruption prosecutor Victor Cazacu before the Supreme Court of Justice (SCJ).
In its challenge, the Commission asks the court to review the legality of the SCP’s September 11, 2026 decision, by which the SCP rejected the Commission’s Resumed Evaluation Report No. 46 of August 14, 2026 and found that Victor Cazacu had passed the external vetting process.
Initial evaluation
During the initial vetting process, the Commission concluded that Victor Cazacu did not meet the financial integrity criterion set out in Article 11 of Law No. 252/2023 and recommended that he fail the vetting. The Commission adopted Evaluation Report No. 22 on January 16, 2026, by a majority vote.
On February 12, 2026, the SCP rejected the report and ordered the vetting procedure to be resumed to “clarify and reassess the issues identified by the Commission.” The decision was adopted with nine votes in favor.
Resumed evaluation
Following the SCP’s decision, the Commission resumed its examination of the issues identified in the initial assessment and held a new public hearing with the prosecutor. After reviewing the relevant materials and the explanations provided during the re-evaluation, the Commission reached the same conclusion regarding the financial integrity criterion. On August 14, 2026, the Commission adopted Resumed Evaluation Report No. 46, again recommending that Victor Cazacu fail the vetting.
On September 11, 2026, the SCP rejected the re-evaluation report with 11 votes. In the same decision, the SCP found that Victor Cazacu had passed the external vetting process.
Under the law, the Commission may challenge SCP decisions adopted as part of the vetting process. The challenge will be examined by the Supreme Court of Justice within 30 days.
